A rental deposit that has not returned can be an unreleased authorization, a completed damage charge or a refund still moving through the banking system. Identify which one occurred before starting a dispute. The correct route depends on the transaction and whether the rental was domestic or cross-border.

This evidence-first process covers cars, short stays and equipment rentals in Europe. It is general consumer information, not legal advice; the contract and applicable national law still matter.

Step 1: Identify the Transaction

Ask the rental company and bank:

  • Is it pending or completed?
  • Was the authorization released, extended or captured?
  • Is it the whole deposit or a separate charge?
  • What are the authorization and transaction dates?

If pending, request release. If captured, request the contractual and factual basis. If refunded, request its reference and processing window.

Step 2: Build One Evidence File

Collect:

  1. Booking confirmation and advertisement
  2. Signed terms and protection product
  3. Deposit and excess disclosures
  4. Pickup/check-in condition report
  5. Original timestamped before-and-after media
  6. Return/checkout report and messages
  7. Card statement showing pending and completed entries
  8. Damage report, estimate, invoice or tariff
  9. A dated timeline of calls and emails

Keep original image files plus wide shots identifying the car, room or equipment.

Step 3: Send a Precise Complaint

State the booking number, amount, dates, outcome requested and response deadline. Send it to the contracting rental company; copy the broker only when the dispute concerns information or protection it sold.

Keep proof of sending and do not rely only on telephone promises.

Step 4: Test the Claim Against the Evidence

For damage, compare pickup and return records. Ask whether the mark exceeds the published fair-wear standard, when it was photographed, how the asset is identified, and whether the calculation uses an invoice, estimate or fixed tariff.

For cleaning, fuel, minibar, toll, key or late-return fees, request the specific record and contractual price. EU consumer law can protect against unclear terms and disproportionately high compensation, but it does not erase a transparent, properly evidenced charge.

Step 5: Choose the European Escalation Route

There is no single dedicated EU rule for every car rental, though basic consumer protections apply.

Netherlands and Italy

If you live in the Netherlands and the trader is established in another participating European country, contact ECC Netherlands. If you live in Italy, contact ECC Italy. The relevant ECC is based primarily on the consumer's residence, not merely where the vehicle was collected or stay took place.

For a domestic Dutch or Italian dispute, use national consumer guidance and check whether the trader participates in sector ADR. Short-stay accommodation should also be distinguished from residential tenancy: holiday bookings and long-term housing deposits can have different legal routes.

Step 6: Use a Card Dispute Accurately

Contact the merchant first unless the bank requires immediate action. Explain whether this is an unauthorized charge, duplicate, service dispute or missing promised refund. Card deadlines may be shorter than legal limitation periods.

Supply the agreement, complaint, reply, return evidence and requested outcome. Chargeback is not guaranteed and does not decide every legal issue. Never describe an authorized deposit as card fraud when the real issue is an unfair capture.
