Please read these terms carefully before using PayRequest. By using our services, you agree to be bound by these terms.

These Terms of Service ("Terms") govern your use of the PayRequest platform and services. PayRequest is a billing platform that helps businesses create payment links, invoices, subscriptions, and manage their billing operations, including software for non-custodial cryptocurrency payments.

Acceptance of Terms
Agreement
By accessing or using PayRequest, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.
Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts. If you're using PayRequest on behalf of a business, you represent that you have authority to bind that business to these terms.
Updates
We may update these terms from time to time. We will notify you of significant changes via email or through our platform. Continued use of PayRequest after changes constitutes acceptance of the updated terms.
Our Services
Platform Description
PayRequest provides a billing platform that enables you to create payment links, send invoices, manage subscriptions, accept payments, and organize your billing operations through various features including customer management, digital product delivery, and booking systems.
Payment Processing & Non-Custodial Crypto Gateway
PayRequest connects to third-party fiat payment providers (such as Stripe, Mollie, PayPal, Ponto) and provides software infrastructure for non-custodial cryptocurrency transactions (including stablecoins like USDC). For fiat payments, you must connect your own merchant accounts. For cryptocurrency transactions, PayRequest provides the interface to generate payment links, but does not operate as a custodian. We do not hold, process, manage, or store your digital assets or private keys. All cryptocurrency transactions occur directly on the peer-to-peer blockchain.
Regulatory Status
PayRequest is a software provider, not a bank, payment institution, or crypto-asset service provider. Because our cryptocurrency features are strictly non-custodial, we never obtain possession or control of your digital assets and we do not provide regulated crypto-asset services — such as custody, exchange, or transfer of crypto-assets on behalf of clients — within the meaning of the EU Markets in Crypto-Assets Regulation (MiCA). All fiat payments are processed by the regulated payment providers you connect to your account.
Service Availability
We strive for 99.9% uptime but cannot guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. Check status.payrequest.io for current service status.
User Accounts
Account Creation
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Account Security
You agree to notify us immediately of any unauthorized access to your account. We recommend enabling two-factor authentication for additional security. You are responsible for any actions taken using your credentials.
Multiple Accounts
Each user may maintain one account unless explicitly authorized otherwise. Creating multiple accounts to circumvent limitations or abuse our services is prohibited.
Verification (KYC/AML)
We may at any time ask you to verify your identity or provide information about your business and the nature of your transactions, for example to comply with anti-money-laundering or sanctions regulations, or at the request of a connected payment provider. We may suspend or restrict your account while verification is pending or if you fail to provide the requested information within a reasonable period.
Payments and Fees
Plans and Platform Fee
PayRequest offers a Free plan that includes every feature, with a platform fee of 2% per successful payment, capped at €25 per transaction. The fee applies only to successful payments. The Business plan is offered on a quote basis and adds enterprise billing automation. Current pricing is always available on our website. All prices are in EUR unless otherwise stated.
Payment Provider Fees
Payment providers (Stripe, Mollie, PayPal) charge their own transaction fees for processing payments. These fees are separate from the PayRequest platform fee and are paid directly to the payment providers.
Refunds
Platform fees are non-refundable except as required by law. Transaction refunds towards your customers are processed through your connected payment provider. Cryptocurrency transactions are settled on-chain and are irreversible; PayRequest cannot refund or reverse them.
Acceptable Use
Lawful Use
You agree to use PayRequest only for lawful purposes and in accordance with these Terms. You are responsible for ensuring your use complies with all applicable laws and regulations in your jurisdiction.
Content Responsibility
You are solely responsible for the content you create, including payment descriptions, invoice text, product listings, and communications sent through our platform. Content must not be misleading, fraudulent, or harmful.
Compliance
You agree to comply with applicable tax laws, consumer protection regulations, and payment card industry standards. This includes correctly calculating and collecting taxes where required.
Cryptocurrency Responsibility
If you use our cryptocurrency billing features, you acknowledge and agree that blockchain transactions are irreversible. PayRequest cannot refund, reverse, or cancel any cryptocurrency transaction. You are solely responsible for verifying the correctness of wallet addresses and ensuring compatibility with the supported networks. PayRequest is not liable for any loss of funds due to smart contract failures, network congestion, or user error.
Prohibited Activities
Illegal Goods and Services
You may not use PayRequest to sell illegal products, controlled substances, weapons, or services that violate applicable laws. This includes goods that are legal in some jurisdictions but illegal in others where you operate.
Fraud and Abuse
Fraudulent activities are strictly prohibited. This includes creating fake transactions, money laundering, using stolen payment information, or any form of financial manipulation or deception.
Harmful Content
You may not use our platform to distribute malware, phishing schemes, harassment, hate speech, or content that exploits or harms minors. Violation will result in immediate termination.
Sanctions and Geographical Restrictions
You explicitly represent and warrant that neither you, nor any entity you represent, nor the end-recipients of your payment links, are subject to financial sanctions or embargoes maintained by the European Union, the United Nations, or the United States (including the Office of Foreign Assets Control - OFAC). You may not use PayRequest if you are operating from, or residing in, a high-risk or sanctioned jurisdiction (including but not limited to Iran, North Korea, Syria, Cuba, and Russia). PayRequest reserves the right to use geofencing (IP-blocking) and other technical measures to restrict access from these regions and may terminate any account found violating these restrictions immediately without prior notice.
Reporting Violations
If you encounter a PayRequest payment link, invoice, or account that you believe violates these Terms — including fraud, phishing, illegal goods, sanctions evasion, or intellectual property infringement — please report it at payrequest.io/report or by emailing [email protected]. We review all reports and take appropriate action, including suspension or termination of the account involved and, where legally required, notification of payment providers, regulators, or law enforcement.
Intellectual Property
Our Rights
PayRequest and its content, features, and functionality are owned by PayRequest B.V. and protected by intellectual property laws. Our trademarks, logos, and brand elements may not be used without permission.
Your Content
You retain ownership of content you create on PayRequest. By using our services, you grant us a license to display, store, and process your content as needed to provide our services.
Feedback
If you provide feedback or suggestions, you grant us the right to use them without compensation or attribution. We appreciate your input in improving our platform.
Limitation of Liability
Service Provided "As Is"
PayRequest is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of our services.
Limitation of Damages
To the maximum extent permitted by law, PayRequest shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
Third-Party Services
We are not responsible for the actions, policies, or services of third-party payment providers, integrations, or services connected to PayRequest. Your use of such services is at your own risk.
Digital Assets
To the maximum extent permitted by law, PayRequest is not liable for any loss of, or inability to access, digital assets, including losses caused by incorrect wallet addresses, unsupported networks or tokens, smart contract failures, blockchain forks or reorganizations, network congestion, fluctuations in value, or the acts or omissions of wallet providers and blockchain networks.
Indemnification
You agree to indemnify and hold harmless PayRequest B.V., its directors, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, the products or services you sell, your violation of these Terms or applicable law, or your infringement of any rights of a third party — including any claims related to cryptocurrency transactions initiated through your payment links.
Termination
By You
You may cancel your account at any time through your account settings or by contacting support. Upon cancellation, you retain access until the end of your billing period. Data export is available before account deletion.
By Us
We may suspend or terminate your account for violation of these Terms, non-payment, fraudulent activity, or as required by law. We will provide notice when reasonably possible before termination.
Data After Termination
Upon account termination, we retain certain data as required for legal compliance, including transaction records for 7 years per Dutch tax law. Personal data is deleted according to our Privacy Policy.
Disputes and Governing Law
Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
Dispute Resolution
Before initiating formal proceedings, we encourage you to contact us to resolve disputes amicably. Many issues can be resolved through our support team within 30 days.
Class Action Waiver
To the extent permitted by law, you agree to resolve disputes on an individual basis and waive any right to participate in class actions against PayRequest.
Changes to Terms
Modifications
We reserve the right to modify these Terms at any time. Significant changes will be notified via email and/or prominent notice on our platform at least 30 days before taking effect.
Review
We encourage you to review these Terms periodically. Your continued use of PayRequest after changes become effective constitutes acceptance of the updated Terms.
Version History
Previous versions of our Terms are available upon request. Contact our support team if you need access to historical versions for compliance purposes.
